Accommodation Agreement

Staying Stipulation
Article 1
Accommodation contracts and related agreements concluded between this hotel and guests shall be subject to the provisions of these terms and conditions, and any matters not provided for in these terms and conditions shall be governed by laws and regulations or generally accepted practices. In the event that this hotel enters into a special contract within the scope of laws and regulations and generally accepted practices, the special contract shall take precedence over the provisions of the preceding paragraph.
Application for Accommodation Contract
Article 2
1. A Guest who intends to make an application for an Accommodation Contract with the Hotel shall notify the Hotel of following particulars:
(1) Name of the Guest(s)
(2) Date of accommodation and estimated time of arrival ;
(3) Accommodation Charges (based, in principle, on the Basic Accommodation Charges listed in the Attached Table NO.1) ;
(4) Other particulars deemed necessary by the Hotel.
2. In case of the Guest requesting, during his stay, extension of the accommodation beyond the date in subparagraph (2) of the preceding paragraph, it shall be regarded as an application for a new Accommodation Contract at the time such request is made.
Conclusion of Accommodation Contracts etc.
Article 3
An accommodation contract shall be deemed to have been concluded when the Hotel accepts the application pursuant to the preceding Article. However, this does not apply if the Hotel proves that it has not accepted the application. When an accommodation contract has been concluded pursuant to the provisions of the preceding Paragraph, an application fee set by the Hotel, limited to the basic accommodation fee for the period of stay (or for three days if it exceeds three days), shall be paid by the date specified by the Hotel. The application fee shall first be applied to the accommodation fee to be ultimately paid by the Guest. In the event that a situation applicable to the provisions of Articles 6 and 18 occurs, the application fee shall be applied in the order of penalty charges and then compensation. The remaining amount, if any, shall be refunded at the time of payment of the accommodation fee pursuant to the provisions of Article 12. If the application fee pursuant to Paragraph 2 is not paid by the date specified by the Hotel pursuant to the same Paragraph, the accommodation contract shall be deemed to have been invalid. However, this shall only apply if the Hotel so notifies the Guest when specifying the date for payment of the application fee.
Special agreement that does not require payment of application fee [Special agreement not to require application fee]
Article 4
​ ​Notwithstanding the provisions of Paragraph 2 of the preceding Article, the Hotel may enter into a special contract requiring no accommodation deposit after the Contract has been concluded as stipulated in the same paragraph.
​ ​In the case when the Hotel has not requested the payment of the deposit as stipulated in Paragraph 2 of the preceding Article and/or has not specified the date of the payment of the deposit at the time the application for an Accommodation Contract has been accepted, it shall be treated as though the Hotel has accepted a special contract prescribed in the preceding paragraph.
Refusal of Accommodation Contracts
Article 5
The Hotel may not accept the conclusion of an Accommodation Contract under any of the following Cases:
(1) When the application for accommodation does not conform with the provisions of these Terms and Conditions;
(2) When the Hotel is fully booked and no room is available;
(3) When the Guest seeking accommodation is deemed liable to conduct himself in a manner that will contravene the law or act against the public order or good morals in regard to his accommodation;
(4) When the Guest seeking accommodation is a syndicate, a gangster, an organization or a participant related with a syndicate, or an antisocial force;
(5) When the Guest seeking accommodation is a corporation or an organization controlled by a syndicate or a gangster;
(6) When the Guest seeking accommodation is a corporation that includes a gangster;
(7) When the Hotel is requested and/or forced to assume an unreasonable burden in regard to the Guest's accommodation;
(8) When the Guest seeking accommodation can be clearly detected as carrying an infectious diseases;
(9) When the Hotel is unable to provide accommodation due to natural calamities, dysfunction of the facilities or any other unavoidable causes;
(10) When the person requesting accommodation is intoxicated or otherwise likely to cause inconvenience to other guests, or when the person's behavior is such that it is a significant nuisance to other guests (when the provisions of Article 10 of the Hyogo Prefecture Hotel and Inn Business Law Enforcement Ordinance apply).
Right to Cancel Accommodation Contracts by the Guest
Article 6
A guest may cancel an accommodation contract by notifying the hotel. If a guest cancels an accommodation contract in whole or in part due to reasons attributable to the guest (except when the hotel has requested payment of the application fee by a specified date pursuant to the provisions of Article 3, Paragraph 2 and the guest cancels the accommodation contract prior to payment), the hotel shall charge a penalty as set forth in Appendix 2. However, in cases where the hotel has entered into a special agreement as set forth in Article 4, Paragraph 1, this shall apply only if the hotel has notified the guest of the obligation to pay a penalty in the event of the guest canceling the accommodation contract. If a guest does not arrive by 8:00 p.m. on the day of accommodation without prior notice (or two hours after the expected arrival time if the guest has specified such time), the hotel may deem the accommodation contract to have been cancelled by the guest.
Right to Cancel Accommodation Contracts by the Guest by the Hotel
Article 7
The Hotel may cancel the Accommodation Contract under any of the following Cases:
(1) When the Guest is deemed liable to conduct and/or have conducted himself or herself in a manner that will contravene the law or act against the public order and good morals in regard to his or her accommodation;
(2) When the Guest can be clearly detected as carrying an infectious diseases;
(3) When the Hotel is unable to provide accommodation due to natural calamities and/or other causes of force majeure;
(4) When the Guest is a syndicate, a gangster, an organization or a participant related with a syndicate, or an antisocial force;
(5) When the Hotel is unable to provide accommodation due to natural calamities and/or other causes of force majeure;
(6) When it is a corporation, there are persons who are members of organized crime group among its officers.
(7) When the Hotel is requested and/or forced to assume an unreasonable burden in regard to his or her accommodation;
(8) When a guest is intoxicated and may be a nuisance to other guests, or when the guest's behavior is such that it is a significant nuisance to other guests (when the guest falls under the provisions of Article 10 of the Hyogo Prefecture Hotel and Inn Business Law Enforcement Ordinance).
(9) When the guest smokes in the guest room, tampers with fire-fighting equipment, or otherwise fails to comply with the prohibited actions set forth in the Usage Regulations stipulated by the Hotel (limited to those necessary for fire prevention).When the Hotel cancels the Accommodation Contract in accordance with the provisions of the preceding paragraph, the Guest will not be charged for any accommodation services that have not yet been provided to the Guest.
REGISTRATION
Article 8
The Guest shall register the following particulars at the front desk of the Hotel on the day of the accommodations:
(1) Name, age, sex, address and occupation of the Guest(s) ;
(2) Except Japanese nationality, passport number, port and date of entry into Japan;
(3) Date and estimated time of departure;
(4) Other particulars deemed necessary by the Hotel.
​ ​In the case when the Guest intends to pay his Accommodation Charges prescribed in Article 12 by any means other than Japanese currency such as credit cards, these credentials shall be shown in advance at the time of registration prescribed in the preceding paragraph.
Occupancy Hours of Guest Rooms
Article 9
​ ​The Guest is entitled to occupy the contracted guest room of the Hotel from 3:00 p.m. to 12:00 p.m. the next day. However, in the case when the Guest is accommodated continuously, the Guest may occupy it all day long, except for the days of arrival and departure.
​ ​The Hotel may, notwithstanding the provisions prescribed in the preceding paragraph, permit the Guest to occupy the room beyond the time prescribed in the same paragraph. In this case, extra charges shall be paid as follows:
(1) Over 3 hours is less than 30% of room charge
(2) Over 3 hours or more and less than 5 hours, 50% of room charge
(3) Over 5 hours or more, 100% of room charge
​ ​In the case when the Guest intends to pay his Accommodation Charges prescribed in Article 12 by any means other than Japanese currency such as credit cards, these credentials shall be shown in advance at the time of registration prescribed in the preceding paragraph.
Observance of Use Regulation
Article 10
The Guest shall observe the Use Regulations established by the Hotel, which are posted within the premises of the Hotel.
Payment of Accommodation Charges
Article 11
The breakdown and calculation method of the accommodation fees, etc. to be paid by the guest shall be as set forth in Schedule 1. Payment of the accommodation fees, etc. set forth in the preceding paragraph shall be made by currency or by any alternative means acceptable to the hotel, such as traveler's checks, accommodation vouchers, or credit cards, at the front cashier at the time of the guest's departure or upon request by the hotel. Accommodation fees shall be charged even if the guest voluntarily does not stay in the room after the hotel has provided the guest with a room and made it available for use.
Liabilities of the Hotel
Article 12
Our hotel will compensate guests for damages caused to them in the fulfillment or non-fulfillment of the accommodation contract and related agreements. However, this does not apply if the damage is not attributable to the hotel. Our hotel displays a fire safety mark as a hotel that complies with fire safety laws and regulations, but in order to deal with the unlikely event of a fire, etc., we have taken out hotel liability insurance.
Handling When Unable to Provide Contracted Rooms
Article 13
If the Hotel is unable to provide a contracted room to a guest, it will, with the guest's consent, arrange accommodation of the same standard elsewhere wherever possible. Notwithstanding the provisions of the preceding paragraph, if the Hotel is unable to arrange accommodation elsewhere, the Hotel will pay the guest a compensation fee equivalent to the breach of contract charges, which will be applied to damages. However, if the Hotel is unable to provide a room due to reasons beyond the Hotel's control, the Hotel will not pay a compensation fee.
Handling of Deposited Articles
Article 14
The Hotel shall compensate for any damages, including loss or breakage, that occur to goods, cash, or valuables deposited by the Guest with the front cashier, unless such damages are due to acts of God. The Hotel shall compensate for any damages, including loss or breakage, that occur due to the Hotel's intention or negligence to goods, cash, or valuables that the Guest brought into the Hotel but did not deposit with the front cashier. However, for items for which the Guest has not specified the type and value in advance, the Hotel shall compensate for such damages up to a maximum of 150,000 yen.
Custody of the Baggage and/or Belongings of the Guest
Article 15
If a guest's baggage arrives at the hotel prior to their stay, the hotel will be responsible for storing it only if the hotel has given its consent in advance of their arrival, and will hand it over to the guest at the front desk when they check in. If a guest's baggage or belongings are found left behind at the hotel after the guest has checked out and the owner is identified, the hotel will contact the owner and ask for instructions. However, if there is no instruction from the owner or the owner is not identified, the hotel will store the baggage for seven days, including the day it was found, after which it will be turned over to the nearest police station. The hotel's responsibility for storing a guest's baggage or belongings in the cases of the preceding two paragraphs shall be in accordance with the provisions of paragraph 1 of the preceding article in the case of paragraph 1, and in accordance with the provisions of paragraph 2 of the same article in the case of paragraph 2.
Liability in Regard of Parking
Article 16
The Hotel shall not be liable for the custody of the vehicle of the Guest when the Guest utilizes the parking lot within the premises of the Hotel or the building includes the Hotel, as it shall be regarded that the Hotel and the building includings the Hotel simply offers the space for parking, whether the key of the vehicle has been deposited with the Hotel or not. However, the Hotel shall compensate the Guest for damages caused through intention or negligence on the part of the Hotel in regard to the management of the parking lot.
Guest's Responsibility
Article 17
​ ​The Guest shall compensate the Hotel for any damages caused through the intention or negligence on the part of the Guest.
Disclaimer
Article 18
​ ​In the case where the Guest uses computer communications such as the internet, the Guest shall have full responsibility of utilizing it. The Hotel shall not be liable for any damage of the Guest caused by system errors or any other reasons. In addition, any damage for the Hotel or the third party caused by inappropriate computer operation of the Guest shall be compensated by the Guest.
